A woman in the Buffalo area was arrested last year for driving while having a blood alcohol content of .33. That is more than four times the legal limit. Recently the DWI charge against her was dropped because she has a rare condition in which her body produces alcohol naturally.

According to a story on The Buffalo News website,

a town judge recently dismissed the aggravated driving while intoxicated charge, after hearing medical evidence that the woman suffers from a rare intestinal disorder called “Auto-Brewery Syndrome” that sometimes turns ordinary food and beverages into alcohol in a person’s body.

The woman who was initially accused is a 35-year-old school teacher and it appears she is the first to have this medical condition in Western New York and possibly the state. Can you imagine getting drunk, or feeling drunk just from eating? That's a cheap date! On the other side of the coin, she was pulled over because she was driving erratically. Her BAC was still above the legal limit which would clearly impair her ability to operate a motor vehicle. Should she still have been charged?
